Mosalea is in its pilot launch phase. Payments (orders, Mosalea Pro subscription) are real and processed by Stripe.
These Terms and Conditions of Use and Sale ("Terms") govern access to and use of the Mosalea platform, published by Loïc Ruyssen, a sole trader (see the legal notice). They apply to every user of the site, whether a buyer or an artist ("you", "the user").
Mosalea is a technical intermediary: the platform connects buyers and artists, structures their exchanges (quotes, messages, delivery, reviews) and secures payment, but does not itself produce any artwork. Each artist remains solely responsible for the artwork they produce and for the commitments made to the buyer.
Prices are freely set by each artist in their quotes, with a minimum of €15 per order. That price is the amount the artist wishes to receive before commission.
Mosalea charges a single commission on each paid order, deducted from the amount paid out to the artist: 6% of the quoted price at the standard rate, reduced to 4% when the artist subscribes to Mosalea Pro (see 5.4), and to 0% during the "founding artist" period (see 5.3). At the 6% and 4% rates, Mosalea applies a minimum charge of €1.50 per order: should the calculation result in a lower amount, the commission is adjusted up to that minimum. This minimum does not apply during the founding period.
The price paid by the buyer is the price set by the artist in the accepted quote: Mosalea adds no fee on top of it, including during the "founding artist" period (see 5.3). The amount payable is shown to the buyer before any payment is confirmed, with no exception or extra fee regardless of the artist's status.
The first 15 artists to sign up on Mosalea benefit from a 0% commission: they receive the full price they set. This applies to the artist's first 8 paid orders and for 6 months from sign-up, whichever limit is reached first ending the offer; beyond that, or for any artist signing up after the 15th, the standard 6% commission applies (4% with a Mosalea Pro subscription).
The founding rank is granted at the artist's first paid publication — a commission offer, or an artwork offered as a paid download. A portfolio published for free does not use up a slot. The rank obtained then remains permanently displayed on the profile.
This offer runs until October 31, 2026 or until all 15 slots are filled, whichever comes first; Mosalea reserves the right to extend that period if the 15 slots are not all filled by then. It is granted automatically on sign-up and cannot be combined with any other promotional offer. A founding artist who also subscribes to Mosalea Pro keeps their commission at 0%: the more favourable rate always applies, with no stacking of reductions. The standard 6% rate, or the reduced Mosalea Pro rate where applicable, resumes automatically at the end of the founding period.
Any artist may optionally subscribe to Mosalea Pro at €5.99 incl. VAT/month, or €59.90 incl. VAT/year on annual billing (10 months paid instead of 12), with no minimum term, cancellable at any time from their Mosalea account (cancellation takes effect at the end of the period already paid for). The artist may change billing period at any time; the change gives rise, where applicable, to a pro-rata adjustment by Stripe.

The subscription has no effect whatsoever on how artists or artwork rank in the discovery feed, in search results or in community challenges. Mosalea does not sell placement.
An artist's access to their own account statistics (views, orders, revenue, conversion rate, timeframes) is free and does not depend on the subscription.
When a buyer unlocks a watermark-free image (price set by the artist, minimum €5), Mosalea charges a commission calculated as applicable rate × price + €0.30: 6% + €0.30 at the standard rate, 4% + €0.30 with the Mosalea Pro subscription. The fixed €0.30 ensures the commission always covers payment processing costs, including at the €5 minimum price. This rate applies to every artist, including during their founding period: the 0% commission exception in article 5.1 only covers commissioned orders, not artwork unlocks.
Each artist receives amounts owed to them (orders and artwork unlocks) by Stripe Connect transfer, using a personal identity (name, date of birth, address, bank details) — no registered business status is required to open this account. Amounts received remain subject to the artist's usual tax and social security obligations, whatever their status (see article 5.7).
Payments for orders and for the Mosalea Pro subscription are processed by Stripe (third-party payment provider) under its own terms, available at stripe.com/legal. Mosalea's Stripe account is live: order and subscription payments involve real movements of money.
Each artist, as an independent contractor, remains solely responsible for issuing a compliant invoice to their clients for each order paid through Mosalea, as well as for their own accounting and tax obligations (declaring their income, VAT where applicable). Mosalea provides the artist, from the order area, with an optional tool allowing them to upload their own invoice so the buyer can download it; a reminder is sent if no invoice has been uploaded in the days following the end of the order. Mosalea neither issues, generates nor guarantees the compliance of any invoice on the artist's behalf: its role is limited to hosting the document and sending that reminder. Mosalea does however issue its own invoice for the commission it collects on each order, made available to the artist from their Mosalea account; this invoicing will evolve before September 1, 2027 to comply with the French mandatory e-invoicing reform.
Each artist has a personal referral link. When an account created through this link makes its first sale as an artist (first order that results in an actual payment), the referrer automatically receives 1 free month of Mosalea Pro subscription (see article 5.4), which stacks with any Pro subscription already in progress. Creating a referred account alone does not trigger any reward. There is no limit to the number of referred accounts that can be rewarded. Mosalea reserves the right to adjust or end this program at any time, with no retroactive effect on rewards already earned.
Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods or services made to the consumer's specifications or clearly personalized. Every order placed on Mosalea corresponds to a custom creation made by an artist, based on the buyer's own brief and instructions: it falls within this legal exclusion.
As a result, the buyer does not have a right of withdrawal once the quote has been accepted and the order has entered production. Accepting the quote constitutes an express request for the personalized service to begin and a corresponding waiver of the right of withdrawal, in accordance with article L221-28, 3° of the French Consumer Code. This information is reiterated to the buyer before their order is confirmed.
This exclusion does not deprive the buyer of the protections set out in article 7 (revisions and disputes) in the event of non-conformity, non-delivery, or the artist's refusal to make a correction.
Revision: if part of the delivery does not match the request, the buyer may ask the artist directly for a revision within 7 days of delivery, within the limit of the revisions included in the quote. The order then returns to production, with no involvement from Mosalea.
Dispute: in the event of a more serious disagreement (non-delivery, refusal to correct, non-conforming content), the buyer may report a dispute. The Mosalea team manually reviews each report before deciding on a refund or on keeping the order as is. The decision is communicated to both parties and logged in an audit trail.
The usage rights granted to the buyer over the delivered artwork are those specified in the accepted quote (personal or commercial use). The artist retains authorship of their work and may, unless otherwise stated in the quote, feature it in their portfolio.
By publishing a work on Mosalea or delivering an order, the artist warrants that they:
This warranty is confirmed by the artist each time a work is published, through an explicit, timestamped declaration. It is distinct from the "human art" charter in article 9, which concerns the absence of generative artificial intelligence: a work can be entirely human-made and still infringe a third party's rights.
The artist is solely responsible for the works they publish and deliver. If a third party brings a claim against Mosalea because of a work published by an artist — in particular on the basis of an infringement of intellectual property rights, image rights or personality rights — the artist undertakes to indemnify and hold Mosalea harmless against the direct consequences of that claim, including reasonably incurred defence costs and any sums Mosalea is ordered to pay. Mosalea will inform the artist of the claim within a reasonable time and allow them to respond.
This warranty does not apply where the claim arises from Mosalea's own conduct, in particular its refusal to act after having been properly notified of manifestly illegal content.
Mosalea acts as a host of the content published by artists: the platform does not review works before they go online and does not editorially select them. It does, however, promptly remove any content whose illegality is reported to it in sufficiently substantiated terms.
Anyone who considers that a work published on Mosalea infringes their rights may notify us:
To be actionable, the notice must make it possible to identify the notifier and the capacity in which they act, to locate the contested content precisely, to describe the original work relied upon, to set out the grounds for the request, and must include a good-faith declaration as to the accuracy of the information provided.
Every notice is reviewed manually, case by case. Where the infringement is established or sufficiently likely, the work is removed from the platform and the artist concerned is informed. The decision is recorded in the moderation audit log. A manifestly unfounded or abusive notice may be set aside and, if repeated, may lead to the measures set out in article 12.
The removal of a work following a well-founded notice constitutes a breach. In the event of repeated breaches of a third party's rights:
Removals resulting from a notice set aside as unfounded are not counted. Each decision is recorded in the moderation audit log and notified to the artist concerned, who may challenge it under the conditions of article 8.6.
An artist whose work has been removed may challenge that decision by writing to contact@mosalea.com, setting out the evidence establishing that they hold the rights over the work. The challenge is reviewed under the same conditions as the original notice; if it is well founded, the work is reinstated. Mosalea is not in a position to settle an intellectual property dispute between two parties: where the rights invoked on both sides are serious and irreconcilable, the content may remain removed until the parties resolve the matter between themselves or before the competent court.
Public previews of artworks (visible in the discovery feed, search, an artist profile, or an artwork page) are protected by a visible watermark and/or an invisible digital fingerprint embedded in the image's pixels, identifying the artwork and the artist concerned. This protection allows each artist to publicly showcase their work while reserving full-resolution, watermark-free exploitation of the work to those who have purchased it or whose download has been unlocked under the conditions of article 5.5.
It is prohibited, by any means whatsoever — including any retouching or generative artificial intelligence tool (object removal, generative inpainting, reinterpretation, or equivalent) — to remove, bypass, mask, weaken, or otherwise alter the visible watermark or digital fingerprint of a public preview; or to download, capture, reproduce, redistribute, or reuse a public preview with the aim of obtaining, or enabling a third party to obtain, a version of the artwork equivalent to the one reserved for those who have lawfully acquired it.
A breach of this article is treated as an infringement of the artist's rights, under the conditions of article 8.4 (notice and takedown) and, in the event of repeated breaches, article 8.5. Mosalea reserves the right to use the digital fingerprint of a preview, and any technical element allowing the origin of an image to be established, as evidence of the provenance of an artwork found outside the platform, including as part of a notice sent to a third-party host (a notice-and-takedown/DMCA-type procedure) or legal action brought by the artist or by Mosalea.
Mosalea is a marketplace for 100% human-made creations. This charter specifies exactly what that means, what is allowed, what is not, and what happens in the event of a breach. It applies to every artwork published on an artist profile and to every order placed via Mosalea.
An artwork is considered human-made when an identified artist has personally made every determining creative decision (composition, shapes, colors, linework, style) and carried out its execution themselves, regardless of the tool used to do so: pencil, paint, graphics tablet, drawing or editing software (Photoshop, Procreate, Clip Studio Paint or equivalents), including with the help of layers, custom brushes, non-generative filters, or visual references used in a way that respects third-party rights.
Each artist confirms this charter when creating their profile and each time they publish an artwork. This declaration is made under their own responsibility. Mosalea does not run any automated technical analysis that would, on its own, block or penalize a publication: a detection tool may, in the future, flag potentially suspicious content for review, but the decision always remains a human one (see 9.4).
Any user may report an artwork they believe was AI-generated from the relevant publication ("AI-generated content" reason). Each report is reviewed manually by the Mosalea team, on a case-by-case basis, before any decision is made. In the event of a confirmed breach:
The decision is communicated to the parties involved and logged in the moderation audit trail, like any other moderation decision.
Users agree not to publish or exchange any unlawful, infringing content, or content that violates a third party's rights. Any content or conduct can be reported from the interface; the Mosalea moderation team reviews each report and may remove content, terminate an order, or suspend an account in the event of a confirmed breach.
Mosalea strives to ensure the availability and security of the platform, without guaranteeing absolute continuity. Mosalea cannot be held liable for artwork produced by artists, nor for the consequences of a buyer's non-compliant use of an artwork, within the limits set by law.
Any user may stop using Mosalea at any time. Mosalea reserves the right to suspend or terminate an account in the event of a breach of these Terms, in particular in the event of non-compliance with the "human art" commitment or abusive behavior toward another user.
These Terms are governed by French law. In the event of a dispute that cannot be resolved amicably, French courts shall have jurisdiction, subject to the mandatory provisions applicable to consumers.
