Mosalea is in its pilot launch phase. Payments (orders, Pro and Elite subscriptions) are real and processed by Stripe.
These Terms and Conditions of Use and Sale ("Terms") govern access to and use of the Mosalea platform, published by Loïc Ruyssen, a sole trader (see the legal notice). They apply to every user of the site, whether a buyer or an artist ("you", "the user").
Mosalea is a technical intermediary: the platform connects buyers and artists, structures their exchanges (quotes, messages, delivery, reviews) and secures payment, but does not itself produce any artwork. Each artist remains solely responsible for the artwork they produce and for the commitments made to the buyer.
Prices are freely set by each artist in their quotes, with a minimum of €15 per order. Mosalea charges a 10% commission on each paid order, deducted from the amount paid out to the artist. This commission is single and all-inclusive: it covers payment processing fees (charged by a third-party provider), and no additional fee is charged separately to the artist or the buyer.
"Founding artists" launch offer: the first 15 artists to sign up on Mosalea benefit from a reduced commission calculated using the formula 2% of the order price + €0.45 (instead of the standard flat rate), which always remains significantly lower than the standard 10% commission while still covering payment processing fees regardless of the order amount. This reduced commission applies to the artist's first 8 paid orders AND for 90 days from their sign-up date, whichever limit is reached first; beyond that, or for any artist who signs up after the 15th, the standard 10% commission (or the applicable Pro/Elite rate) applies. The artist must also publish at least one artwork or commission offer within 14 days of signing up: otherwise, their founding slot is automatically revoked (with a reminder sent 7 days after sign-up) and their rate reverts to the standard rate. This offer is available until September 30, 2026, or until all 15 slots have been filled, whichever comes first; Mosalea reserves the right to extend this period if not all 15 slots have been filled by that date. This offer is granted automatically upon sign-up and cannot be combined with any other promotional offer.
Mosalea Pro subscription: any artist may optionally subscribe to Mosalea Pro for €5.99 (VAT included) per month, or €59.90 (VAT included) per year with annual billing (i.e. 10 months paid instead of 12), with no fixed commitment period, cancellable at any time from their Mosalea account (cancellation takes effect at the end of the period already paid for). This subscription grants a reduced commission of 8% (instead of 10%) on orders paid for during the subscription period, a "Pro" badge visible on the public profile, profile statistics (views, orders, conversion rate) visible only to the artist, and the ability to customize their public profile's accent color.
Mosalea Elite subscription: any artist may also subscribe to Mosalea Elite for €14.99 (VAT included) per month, or €149.90 (VAT included) per year with annual billing (same 10-months-paid-instead-of-12 principle), with no fixed commitment period, cancellable at any time from their Mosalea account under the same conditions as the Pro subscription. This subscription grants a reduced commission of 6% on paid orders and a reduced rate on paid unlocks of watermark-free artwork (see formula below), an "Elite" badge visible on the public profile, as well as the same benefits as the Pro subscription (profile statistics, accent color customization). A subscribed artist may switch tiers (Pro to Elite or vice versa) and/or billing period (monthly to annual or vice versa) at any time from their Mosalea account; the change takes effect immediately and, where applicable, results in a pro-rated adjustment for the current period via Stripe.
Paid unlocks of watermark-free artwork: when a buyer unlocks a watermark-free image (price set by the artist, minimum €5), Mosalea charges a commission calculated using the formula tier rate × price + €0.40: 8% + €0.40 at the standard rate, 7% + €0.40 with a Pro subscription, 5% + €0.40 with an Elite subscription. The fixed €0.40 amount ensures the commission always covers payment processing fees, even at the €5 minimum price.
The Mosalea Pro and Mosalea Elite subscriptions cannot be combined with each other, nor with the "founding artists" launch offer: an artist can only be subject to one commission rate at a time, and the rate most favorable to the artist automatically applies (the founding artists offer, as long as it remains active, takes priority over the Pro and Elite subscriptions).
Payments for orders and for Mosalea Pro and Elite subscriptions are processed by Stripe (a third-party payment provider) under its own terms, available at stripe.com/fr/legal. Mosalea's Stripe account is active in production: order and subscription payments involve a real movement of funds.
Invoicing: each artist, as an independent service provider, remains solely responsible for issuing a compliant invoice to their clients for each order paid via Mosalea, as well as for their own accounting and tax obligations (declaring their income, VAT where applicable). Mosalea provides the artist, from within the order's workspace, with an optional tool allowing them to upload their own invoice so the buyer can download it; a reminder is sent to the artist if no invoice has been uploaded within a few days of the order's completion. Mosalea does not issue, generate, or guarantee the compliance of any invoice on the artist's behalf: its role is limited to hosting the document and sending this reminder. Mosalea does, however, issue its own invoice for the commission it charges on each order, made available to the artist from their Mosalea account; this invoicing process will evolve before September 1, 2027 to comply with the French mandatory e-invoicing reform.
Under article L221-28 of the French Consumer Code, the right of withdrawal does not apply to contracts for the supply of goods or services made to the consumer's specifications or clearly personalized. Every order placed on Mosalea corresponds to a custom creation made by an artist, based on the buyer's own brief and instructions: it falls within this legal exclusion.
As a result, the buyer does not have a right of withdrawal once the quote has been accepted and the order has entered production. Accepting the quote constitutes an express request for the personalized service to begin and a corresponding waiver of the right of withdrawal, in accordance with article L221-28, 3° of the French Consumer Code. This information is reiterated to the buyer before their order is confirmed.
This exclusion does not deprive the buyer of the protections set out in article 7 (revisions and disputes) in the event of non-conformity, non-delivery, or the artist's refusal to make a correction.
Revision: if part of the delivery does not match the request, the buyer may ask the artist directly for a revision within 7 days of delivery, within the limit of the revisions included in the quote. The order then returns to production, with no involvement from Mosalea.
Dispute: in the event of a more serious disagreement (non-delivery, refusal to correct, non-conforming content), the buyer may report a dispute. The Mosalea team manually reviews each report before deciding on a refund or on keeping the order as is. The decision is communicated to both parties and logged in an audit trail.
The usage rights granted to the buyer over the delivered artwork are those specified in the accepted quote (personal or commercial use). The artist retains authorship of their work and may, unless otherwise stated in the quote, feature it in their portfolio.
Mosalea is a marketplace for 100% human-made creations. This charter specifies exactly what that means, what is allowed, what is not, and what happens in the event of a breach. It applies to every artwork published on an artist profile and to every order placed via Mosalea.
An artwork is considered human-made when an identified artist has personally made every determining creative decision (composition, shapes, colors, linework, style) and carried out its execution themselves, regardless of the tool used to do so: pencil, paint, graphics tablet, drawing or editing software (Photoshop, Procreate, Clip Studio Paint or equivalents), including with the help of layers, custom brushes, non-generative filters, or visual references used in a way that respects third-party rights.
Each artist confirms this charter when creating their profile and each time they publish an artwork. This declaration is made under their own responsibility. Mosalea does not run any automated technical analysis that would, on its own, block or penalize a publication: a detection tool may, in the future, flag potentially suspicious content for review, but the decision always remains a human one (see 9.4).
Any user may report an artwork they believe was AI-generated from the relevant publication ("AI-generated content" reason). Each report is reviewed manually by the Mosalea team, on a case-by-case basis, before any decision is made. In the event of a confirmed breach:
The decision is communicated to the parties involved and logged in the moderation audit trail, like any other moderation decision.
Users agree not to publish or exchange any unlawful, infringing content, or content that violates a third party's rights. Any content or conduct can be reported from the interface; the Mosalea moderation team reviews each report and may remove content, terminate an order, or suspend an account in the event of a confirmed breach.
Mosalea strives to ensure the availability and security of the platform, without guaranteeing absolute continuity. Mosalea cannot be held liable for artwork produced by artists, nor for the consequences of a buyer's non-compliant use of an artwork, within the limits set by law.
Any user may stop using Mosalea at any time. Mosalea reserves the right to suspend or terminate an account in the event of a breach of these Terms, in particular in the event of non-compliance with the "human art" commitment or abusive behavior toward another user.
These Terms are governed by French law. In the event of a dispute that cannot be resolved amicably, French courts shall have jurisdiction, subject to the mandatory provisions applicable to consumers.
